1. Acceptance of Terms

By accessing or using AI No FOMO (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and AI No FOMO ("we," "us," or "our").

We reserve the right to modify these Terms at any time. We will notify subscribers of material changes via email. Continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

2. Description of Service

AI No FOMO is a paid subscription service that provides entrepreneurs and small business owners with curated AI tool recommendations, use-case guides, personalized recommendations, and a vetted directory of AI tools relevant to business use. The Service is delivered via a member-access web platform and periodic email communications.

Content includes, but is not limited to: weekly curated AI tool picks, step-by-step use-case guides, tool directory access, and personalized recommendations. All content is for informational purposes and represents our editorial opinion based on testing and research.

3. Subscription and Payment

Access to the Service requires a paid subscription. We offer monthly and annual billing options at the rates listed on our Pricing page. All prices are displayed in US dollars (USD).

All payments are processed by Paddle.com Market Limited ("Paddle"), which acts as the Merchant of Record for all transactions. When you purchase a subscription, you are purchasing from Paddle, subject to Paddle's terms of service. Paddle handles all payment processing, tax collection, and remittance.

By subscribing, you authorize Paddle to charge your chosen payment method for the applicable subscription fee on the billing cycle you select (monthly or annually). You represent that you have the legal right to use the payment method you provide.

4. Automatic Renewal and Cancellation

Subscriptions renew automatically at the end of each billing period (monthly or annually) at the then-current subscription rate, unless you cancel before the renewal date. You will receive a reminder email before each annual renewal.

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period — you will retain access until that date. We do not prorate refunds for unused time within a billing period, except as described in our Refund Policy.

5. Refund Policy

We offer a 30-day money-back guarantee for new subscribers. Please see our Refund Policy for complete details on eligibility, process, and timelines. Refund requests are processed through Paddle.

6. Account Responsibilities

You are responsible for maintaining the security of your account credentials. You agree to notify us immediately at support@ainofomo.com if you suspect unauthorized access to your account. You are responsible for all activity that occurs under your account.

Your subscription is for individual use only. You may not share, sell, or transfer access to your account or the member-only content to any third party.

7. Acceptable Use

You agree not to:

  • Share, resell, or redistribute subscription content without our written permission
  • Scrape, copy, or systematically extract content from the Service
  • Use the Service in any way that violates applicable laws or regulations
  • Attempt to gain unauthorized access to any part of the Service or its related systems
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity

Violation of these terms may result in immediate termination of your subscription without refund.

8. Intellectual Property

All content within the Service — including but not limited to text, guides, tool reviews, recommendations, graphics, and the overall compilation — is owned by AI No FOMO or its content licensors and is protected by copyright and other intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable, revocable license to access and use the content for your own personal and business purposes. You may not reproduce, distribute, or create derivative works from the content without our express written consent.

Third-party tool names and logos mentioned within the Service remain the property of their respective owners. Mention of third-party tools does not constitute an endorsement or affiliation.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

AI tool recommendations and reviews are based on our independent testing and editorial judgment. We make no guarantee that any tool will be suitable for your specific business needs, perform as described by the tool's developer, remain available or at the reviewed price, or produce any particular outcome for your business.

10. Limitation of Liability

To the maximum extent permitted by law, AI No FOMO shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or any AI tools recommended within it, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from or related to these Terms or the Service shall not exceed the total amount you paid for the Service in the twelve (12) months preceding the claim.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which AI No FOMO operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.

12. Changes to the Service

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We will provide reasonable notice of material changes to subscribers via email. If we discontinue the Service entirely, we will provide a prorated refund for any prepaid subscription time remaining.
